Terms of Service
1. Acceptance
By accessing or using MyRadAgent AI ("Service"), operated by MyRadAgent ("we", "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Eligibility and Intended Use
MyRadAgent is a clinical decision-support tool intended solely for use by licensed radiologists, radiology residents under attending supervision, and other qualified medical professionals ("Professional Users"). The Service is not intended for patient use, is not a diagnostic medical device, and does not replace professional medical judgment.
- You represent that you are a Professional User in good standing in your jurisdiction.
- You are solely responsible for the final content of any report you sign or distribute.
- AI output is a draft to be reviewed, edited, and confirmed by a qualified professional before being incorporated into any patient record or clinical communication.
3. PHI and HIPAA Compliance
BAA status: Pending — in active negotiation with OpenAI, Anthropic, Google, and Railway as of 2026-04-22. Until all four BAAs are executed, users MUST NOT upload PHI. Use de-identified data only during the beta period. See the Privacy Policy subprocessor table for current status.
- Users are responsible for ensuring that any data submitted complies with applicable privacy laws (HIPAA, GDPR, state laws).
- PHI redaction is applied to text inputs before LLM processing; however, this automated redaction is a defense-in-depth measure and is not a substitute for user-level deidentification.
- A Business Associate Agreement (BAA) is required before real PHI may be uploaded. Contact support@myradagent.ai to request one.
4. Acceptable Use
- Do not use the Service to generate reports for patients you are not authorized to interpret.
- Do not attempt to reverse-engineer, scrape, or extract the training corpus or prompts.
- Do not share your login credentials. Each professional user must have their own account.
- Do not upload malware, attempt to bypass rate limits, or interfere with Service availability.
5. Subscriptions, Billing, Cancellation
- Paid subscriptions are billed in advance on a recurring basis (monthly or annual) via Stripe.
- You may cancel at any time; access continues through the end of the paid period.
- All payments are non-refundable except where required by applicable law.
- Overage charges for usage beyond tier limits are billed at the overage rate listed on our pricing page at time of use.
- Your data is retained for 90 days after cancellation and then deleted, unless a statutory hold applies.
6. Intellectual Property
You retain ownership of all content you submit. You grant us a limited, revocable license to process that content as necessary to provide the Service. We may retain aggregated, deidentified statistics for quality monitoring and improvement.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY CLINICAL OR MEDICOLEGAL CONSEQUENCE OF ANY AI OUTPUT. OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
8. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, or expense arising from your use of the Service in violation of these Terms, including any claim that an AI-generated draft you signed or distributed caused harm to a patient or third party.
9. Termination
We may suspend or terminate your access for breach of these Terms, fraudulent activity, non-payment, or conduct that exposes us or other users to risk.
10. Governing Law
These Terms are governed by the laws of California, USA. Disputes will be resolved in the state and federal courts located in Los Angeles County, California, except as required by applicable consumer-protection law.
11. Changes
We may revise these Terms. Material changes will be announced by email or in-app notice at least 30 days before taking effect.
